Zymol Enterprises, Inc. has settled a year-old trademark infringement, unfair competition, copyright and trade secret lawsuit against Anwander And Co. AG.

KILLINGWORTH, Conn./EWORLDWIRE/Nov. 11, 2005 --- Zymöl Enterprises, Inc. of Killingworth, Connecticut, a manufacturer and worldwide distributor of Zymöl(R) exclusive products, has settled a year-old trademark infringement, unfair competition, copyright and trade secret lawsuit against Anwander & Co. AG, makers of Swissol and Swizöl brand car-care products in Switzerland.

On the eve of depositions, Anwander, a former distributor of Zymöl products in Europe, agreed to Zymöl's demands that Anwander abandon the Swissol name worldwide, restrict advertising and sale of Swizöl products to four German-speaking countries, and change labeling, certain colors and scents of various Anwander car-care products.

But, Awander gave us everything we needed in order to protect the famous Zymöl(R) trademark and minimize consumer confusion. The settlement also resolves Zymöl's claims against Anwander's U.S. distributor, Jack Camarda, while allowing Zymöl to pursue world-wide claims against other Anwander distributors and Resellers that may be misappropriating Zymöl intellectual property.

Bennett noted that the lawsuit against Anwander is only the most recent dispute arising out of the company's longstanding policy of aggressive protection of its famous Zymöl(R) trademark and against any intellectual property misuse.

In general, the agreement between Zymöl and Anwander requires Anwander to:

- forever cease and refrain from using the Zymöl(R) name in any manner

- abandon the Swissol name worldwide and transition to a designation that will be presented to Zymöl in advance

- restrict use of the Swizöl name to products, Web sites, and advertisements written in German, Italian and French and accessible only within Germany, Austria, Switzerland and Lichtenstein.

Anwander also will discontinue the use of various labels, product colors and scents that were similar to those used by Zymöl and cooperate with Zymöl regarding future counterfeit product and trademark enforcement actions.
