SAN DIEGO/EWORLDWIRE/May 28, 2008 --- The Fraud Discovery Institute Inc. (FDI) just released the results of new lead testing performed by an FDA registered, independent lab on Wednesday morning that revealed that the primary Herbalife (NYSE: HLF) children's product, "Vanilla Kids Shake," materially exceeds the .5 micrograms of lead content allowed under California law without a warning label. "If a child, in the name of good health and nutrition, simply consumed two of these drinks per day like the following Web sites recommend - 'http://www.ltwldemo.com/shoponline/msc.php?action=view&id=1100&sid=639..., and 'http://www.herbalstep.com/prodinfo/Herbalife_Kids_Shake_14_Packets_F03..., 'http://www.thathealthplace.com/targetednutrition/childrenssolutions/he...' - that child would be getting three times the amount of lead the State of California allows per day by law," said Barry Minkow, co-founder of the Fraud Discovery Institute.

Last week in response to the excessive, law breaking lead levels uncovered in FDA registered, independent lab tests of 6 of Herbalife's primary adult products, "Senior management of Herbalife consistently appealed to FDA guidelines as some kind of shield and immunity from California law - but Herbalife can no longer assert the 'FDA guideline defense' because Mr. Grell's memo (now posted at 'http://www.frauddiscovery.net') clearly demonstrates Herbalife products currently contain banned substances by the FDA - the same FDA that management states the company is allegedly in full compliance with," added Minkow. "Although it is not illegal to have products that contain banned substances, it is certainly inconsistent."

According to Dietary Supplement Committee Co-Founder and legal expert Christopher Grell, no less than three of Herbalife's current products contain two or more FDA banned substances. Mr. Grell points out that products such as Herbal Aloe Drink Ready-to-Serve, Herbal Aloe Drink Concentrate and Activated Fiber Table-Ox Bile contain Aloe which the FDA recently declassified from safe to unsafe and therefore can no longer be purchased over the counter (OTC) at regular retail stores with products regulated by the FDA. The Herbalife Activated Fiber Table-Ox Bile contains another FDA banned substance: sodium chilate - a substance removed from OTC laxatives by the FDA but still present in Herbalife's fiber product.

"This company, a health and nutrition company which allegedly has the sole purpose of improving the physical health of our society's most vulnerable - namely children, conveniently but not consistently uses the FDA when it serves their best interest. Herbalife, however, now faces the dilemma of illegal lead levels in the company's most popular children's products - with no warning labels to parents about the excessive, law breaking lead content.
