Kenneth Clair, a man who has awaited justice on California's Death Row since 1985, will finally find out if the U.S. Appellate Court will serve justice to him, or repeat the injustice that the Orange County Superior Court served him when they sentenced him to death for a crime that facts and evidence show he did not commit. Orange County Superior Court convicted Clair to death, for a crime a child (star) witness said was committed by a white man; Clair is an African-American. Despite the statements of the witness, the Orange County District Attorney and the Santa Ana Police Department tried and convicted Clair. The (star) child witness passed a crucial test to differentiate between the races, gave an accurate account of the stab wound placement on the victim's body, identified garments that the victim was tied up with, and the placement of the victim's panties. The (star) child witness description of the murder coincided with the coroner's lab report. The account did not coincide with Clair committing the murder, and, in fact, a deal was made between the District Attorney and Clair's own trial attorney to keep the child (star) witness off the stand and not enter the police reports of his interview. In 2007, C. J. Ford Jr., with C. J. Ford Private Investigations discovered that the District Attorney had been secretly running DNA testing, which results exonerated Kenneth Clair of the murder; Clair's defense attorney was not informed. Instead of pursuing the parties that actually left the DNA, Ford believes that the District Attorney and others decided that they would rather see Kenneth Clair executed than to reveal they sent the wrong person to death row. After being exposed, the most recent theory advanced by the District Attorney is that Kenneth Clair is guilty, but he didn't leave any DNA evidence. During the Oct. 1 court appearance, the State Attorney will argue as to why the State of California should continue to hold Kenneth Clair in State Prison while Clair's attorney will argue in rebuttal of any attempt to hold his client; a panel of judges will make the decision.
