ST. LOUIS/EWORLDWIRE/Jan. 12, 2006 --- A study by LegalMetric shows that the win rate for patent owners fell in 2005 (compared to 2004) from 64 percent to 63 percent. The contested win rate (eliminating consent judgments and default judgments from the calculation) fell somewhat more, from 27 percent to 25 percent. The nationwide win rate at trial for 2005 was 56 percent (also down from previous years). As in past years, accused infringers prevailed predominantly through summary judgment. Sixty-three (63) percent of all accused infringer wins were on summary judgment.

LegalMetric announced that there is substantial variation in win rates from district to district. For example, LegalMetric's District Reports for two popular patent districts, the Eastern District of Texas and the Northern District of California, show that the patent owner win rate in the Eastern District of Texas for 2005 was 20 percent higher than the win rate in the Northern District of California.
