Dr. Yue Requests Oral Argument before the Court on Non-Party Preclusion

SAN FRANCISCO/EWORLDWIRE/July 28, 2008 --- Accomplished software developer in distributed computing and RPC technologies Dr. D.X. Yue today petitioned the U.S. Ninth Circuit Court of Appeal in San Francisco to grant oral argument in the appeal (Ninth Circuit Case No. 08-15927) of a copyright lawsuit (U.S. District Court, Northern District of Calif.: Case No. C07-05850-MJJ-EDL) against two U.S. technology corporations.

Dr. Yue sued Sun Microsystems (NASDAQ: JAVA), StorageTek and certain individuals for copyright infringement of his software. His pro se lawsuit was supported by hard evidence, including Sun's internal e-mails which admitted unauthorized copying. A federal district judge in California dismissed the action without considering the merits of his claims. Dr. Yue then appealed to the Ninth Circuit.

The appeal raises very important questions on Due Process rights of pro se litigants. The appeal is also important for intellectual property protection, especially copyright protection of computer software in the U.S. and abroad. Dr. Yue believes that being able to speak to the appellate judges will help the court understand the facts and issues.

Yong Li, also a pro se plaintiff, agreed: "The right to self-representation in court is a basic right of a free and self-reliant people. Dr. Yue should be allowed to tell the true facts to the honorable judges of the Ninth Circuit."
