NEW YORK/EWORLDWIRE/Dec. 3, 2013 --- On Dec. 3, 2013, the Law Offices of Michael S. Lamonsoff took the first action to hold Metro-North accountable for the senseless, preventable derailment of Dec. 1, 2013. The firm was the first to file a claim with the Metro-North legal department to begin the judicial process of holding Metro-North liable for the horrific injuries sustained by Denise Williams, a retired army colonel and dentist.

Dr. Williams was en route to an annual dentist convention at the Jacob Javits Center on Dec. 1, 2013.
Williams boarded a Metro-North train believing she would arrive at Grand Central Station on time and, most importantly, safely. Instead, after a preventable derailment caused by the negligence of Metro North, Dr. Williams found herself strewn amongst the wreckage of the train and pinned by protruding trees on the banks of the Hudson River. While thousands of pounds of steel pressed against her body, rescue workers worked to extract her from the scene. A fellow passenger known to Dr. Williams only by the name Steven, comforted her with words of prayer and compassion. Rather than viewing the latest advancements in dentistry with her colleagues, Dr. Williams found herself wondering if she would ever walk again, see her family again, or even continue her life. Only the words of Steven and the tireless efforts of the rescue workers helped distract Dr. Williams from just how dire her situation was. Now, Dr. Williams lies in a New York City hospital with rods and screws inserted into her fractured back amongst other injuries. She remains a devastated victim of a senseless and preventable tragedy.

There have been a number of instances of negligence involving Metro North in the past year, including the derailment of a freight train just a short distance from this past Sundays derailment. Sadly, this is not the first time the Law Offices of Michael S. Lamonsoff has sought justice for the victims of that negligence. The office has filed lawsuits on the behalf of victims of the Metro-North derailment that occurred near Fairfield, Conn., in May of 2013. In that debacle, Metro-North, through its negligence, allowed two trains carrying a combined 500 passengers to strike each other at high speed. Two avoidable derailments, leaving hundreds injured or dead, is a systemic issue that requires justice for the victims.

There are many questions that need to be answered:

- Why did Metro-North allow their tracks to fall into disarray, including the failure to remove tracks over a hundred years old?
- Why hasn't Metro-North fully complied with the Railway Safety Improvement Act of 2008?
- Why wasn't PTC (Positive Train Control, a safeguard against excessive speed) installed in this locomotive?
- Would the safeguard have prevented this accident?
- Most disturbingly, how many commuters will become senseless victims before Metro-North makes safety its first priority?
