NEW YORK/EWORLDWIRE/Dec. 4, 2013 --- On Thursday, Dec. 5, 2013, at 1:30 p.m. two Metro-North derailment victims, Dr. Denise Williams and Mr. Kelon McFarlane, will be available to the media, either in person or via Skype video conference, at the Law Offices of Michael S. Lamonsoff, 80 Maiden Lane, 12th Floor, New York NY 10038.

On Dec. 3, 2013, the Law Offices of Michael S. Lamonsoff took the first action to hold Metro-North accountable for the senseless, preventable derailment of Dec. 1, 2013:

- The firm was the first to file a claim with the Metro-North legal department to begin the judicial process of holding Metro-North liable for the horrific injuries sustained by Williams, a retired army colonel and dentist.
- On Dec. 4, 2013, the Law Offices of Michael S. Lamonsoff filed its second claim on the behalf of yet another victim, McFarlane, a young student on his way to Manhattan to visit a family member.

Over the past few days, victims, their families, and the general public have been shocked to learn the circumstances of this derailment:

- They've been told their trauma was likely due to a careless conductor nodding off while operating a train at 82 miles per hour in a 30 mile per hour zone.
- They've been told that there is a technology called PTC (Positive Train Control) which would have likely prevented this tragedy. This technology, which has existed for over 20 years, automatically slows a train down when traveling at an excessive or unsafe speed. PTC takes human error - responsible for 40 percent of train crashes, out of the equation.

In 1990, the National Transportation Safety Board (NTSB) counted PTC among its most important safety improvements to eliminate human error as a cause of derailments. In 2008, the Rail Safety Improvement Act mandated PTC on commuter railways. Rather than making PTC implementation its priority, Metro-North has attempted to delay and postpone complying with this federal requirement placing its commuters at risk.

Now it's time for the victims and their families to tell their stories.

The victims wish to offer their thanks and appreciation for the first responders, and other passengers, who provided life-saving aid in the aftermath of the derailment.
