SCRAT, The Star of 'Ice Age,' Goes Unprotected, Says Creator Ivy Silberstein

NEW YORK/EWORLDWIRE/Nov. 30, 2015 --- America watched "Scrat," star of Ice Age and one of the most successful motion picture franchises ever (https://en.wikipedia.org/wiki/Ice_Age_(franchise)), lead the 89th Macy's Day Parade down 34th Street on Thanksgiving, but - according to artist and character creator Ivy Silberstein, 20th Century Fox is marketing, licensing, publicizing, promoting, and merchandising the star cartoon character without a trademark.

"Scrat is not a federal registered trademark, and it cannot be bought," said Silberstein.

Silberstein owns the trademark for Sqrat, a cartoon character that Fox has used in its Ice Age movies and shorts, and that has been the center of merchandising, marketing, and other products for the last 13 years. "Ice Age/Scrat is the biggest international cartoon in the history of the world, grossing over $4 billion to date. The fifth Ice Age Movie sequel is slated for July 2016," added Silberstein.

Sqrat is a federal registered trademark (Registration #4,159,256) registered June 12, 2012, to Ivy Silberstein a/k/a Ivy Supersonic.

The cartoon creator lives in New York City and originally created the cartoon "Sqrat," part squirrel part rat, and coined her Sqrat "The New York City Mascot" in May 1999.

"In America and around the world we have laws that protect owners and creators against trademark infringement and theft of conversion, and laws do apply, even for movie and media giant Fox and its conglomerate. My attorney served Fox on November 2, 2015, and we are waiting on the organization's reply. I thank God and my trademark attorney David Einhorn of Baker Hostetler for my federal registered trademark, and I want to make it perfectly clear that Fox does not have a trademark for Scrat, that Fox has been ruled against with prejudice at the USPTO, and that Fox is infringing on my property, and my attorney Brett J. Schreiber litigating the case is very confident that I will prevail."

Schreiber, of Thorsnes Bartolotta McGuire LLP, told Law360 that his client has been unable to use her own registered mark for Sqrat because Fox has saturated the market. "The common perception is going to be that she is infringing on Fox's character when the opposite is true," Schreiber said. Schreiber is very confident that his client will prevail in this lawsuit, saying that this type of infringement is probably more common than people think. "The difference here is that Ivy has a lot of fight in her, and she's not going to let them get away with it, and neither will we."
